Personal data collected by PTC Czajkowski is processed in accordance with provisions of Regulation of the European Parliament and of the Council (EU) 2016/679 of 27.04.2016 on the protection of individuals with regard to the processing of personal data and on the free flow of such data and repeal of Directive 95/46/EC (general regulation on data protection) (OJ EU L 119, p. 1), hereinafter referred to as: GDPR.

PTC Czajkowski makes special efforts to protect the privacy and information provided to it, and regarding its Customers, Associates and people interested in cooperation.

PTC Czajkowski, with due diligence, selects and uses appropriate technical measures, including programming and organisational ones, to protect the personal data processed, in particular secures data against access by unauthorised persons, disclosure, loss and damage, unauthorised modification and their processing in violation of applicable laws.

1.2. Purposes and legal grounds for processing personal data. We process your personal data for the following purposes, based on legal grounds and in the periods indicated below:

1.2.1 Consideration of complaints and requests, answers to questions

Personal data: name, surname, e-mail address, telephone number, home address, IP number

Purpose of the processing: Art. 6 paragraph 1 letter f) GDPR, i.e. processing for the purposes of the legitimate interests pursued by PTC Czajkowski, consisting in increasing the level of services provided, building positive relationships with Customers.

Data retention period: up to 5 years from the day the complaint or application is submitted, or we receive a request from you

1.2.2 Creating a Customer account:

Personal data: name, surname, e-mail address, telephone number, company name, NIP number, office/home address

Legal basis: Art. 6 paragraph 1 letter b) GDPR, i.e. processing in order to take steps at your request, prior to entering into a contract and processing necessary for the performance of a contract to which you are party

Purpose of the processing: conclusion and performance of the contract

Data retention period: until the expiry of the limitation period for claims regarding the performance of the last contract

1.2.3 Conclusion and performance of the contract

Personal data: name, surname, e-mail address, telephone number, company name, NIP number, office/home address, registration number

Legal basis: Art. 6 paragraph 1 letter b) GDPR, i.e. processing in order to take steps at your request, prior to entering into a contract and processing necessary for the performance of a contract to which you are party

Purpose of the processing: conclusion and performance of the contract.

Data retention period: until the expiry of the limitation period for claims regarding the performance of the contract

1.2.4 Making a payment, checking payments

Personal data: name, surname, e-mail address, telephone number, company name, NIP number, bank account number, debit card number

Personal data: e-mail address, first name

Legal basis: Art. 6 paragraph 1 letter a) GDPR, i.e. based on your consent to the processing of your personal data

Purpose of the processing: providing you with Newsletter service by PTC Czajkowski.

Data retention period: until the date of withdrawal of your consent to the processing of personal data

1.2.6 Determination, pursuit and enforcement of claims and defence against claims in proceedings before courts and other state authorities

Legal basis: Art. 6 paragraph 1 letter f) GDPR, i.e. processing for the purposes of the legitimate interests pursued by PTC Czajkowski, consisting in determining, pursuing and enforcing claims and defending against claims in proceedings before courts and other state authorities.

1.2.8 Recruitment

Personal data: name, surname, e-mail address, phone number, company name, NIP number, office/home address, date of birth, names of parents, education, course of previous employment

Legal basis: Art. 6 paragraph 1 letter a) GDPR, i.e. based on your consent to the processing of your personal data

Purpose of the processing: processing of personal data for recruitment purposes

Data retention period: 3 months from the day of ending the recruitment for a given position

1.3 Voluntariness of providing personal data

Providing required personal data is voluntary and is a condition for PTC Czajkowski to provide services to you through the websites (e.g. sending a newsletter, concluding a contract, contacting you).

1.4 Personal data recipients

The current list of entities, to which we pass your personal data, is located at the Administrator’s office.

1.5 Rights of the data subjects

Under GDPR, you have the right to:

– demand access to your personal data
– demand rectification of your personal data
– demand removal of your personal data
– demand limitation of processing of your personal data
– lodge an objection to the processing of your personal data
– demand transfer of your personal data.

In the event of PTC Czajkowski being notified of any of the above-mentioned requests without undue delay – and in any case within one month of receiving the request – PTC Czajkowski will provide you with information about the actions taken in connection to the request you have made.

If necessary, PTC Czajkowski may extend the monthly period by another two months due to the complex nature of the request or the number of requests.

In any case, PTC Czajkowski will inform you on the extension within one month from receiving your request, stating the reasons for the delay.

1.5.1 Right of access to personal data (Art. 15 GDPR)

You have the right to obtain information on whether PTC Czajkowski processes your personal data.

If we process your personal data, you have the right to:
access personal data, obtain information on the purposes of processing, categories of personal data being processed, recipients or categories of recipients of this data, planned retention period of your data or criteria for determining this period, rights that you have under the GDPR and the right to lodge a complaint to the President of the of Personal Data Protection Office, on the source of such data, on automated decision making, including profiling and on safeguards applied in connection with the transfer of these data outside the European Union; obtain a copy of your personal data.

1.5.2 Right to rectification of personal data (Art. 16 GDPR)

If your personal data is incorrect, you have the right to request PTC Czajkowski to rectify your personal data without delay. You also have the right to request that PTC Czajkowski supplement your personal data.

1.5.3 Right to erasure of your personal data (the so-called “right to be forgotten”) (Art. 17 GDPR)

You have the right to request the removal of your personal data when:
– your personal data is no longer necessary for the purposes for which it was collected or processed in any other way;
– you have withdrawn a specific consent in the scope of which your personal data had been processed based on your consent;
– your personal data have been unlawfully processed;
– you have lodged an objection to having your personal data processed for the purposes of direct marketing, including profiling, in the scope in which the processing of personal data is associated with direct marketing;
– you have lodged an objection to having your personal data processed in association with processing necessary for performance of a task carried out in the public interest or processing necessary for the purposes of the legitimate interests pursued by PTC Czajkowski or by a third party.

Despite your request for removal of personal data, PTC Czajkowski may further process your data in order to determine, assert or defend the claims, about which you will be informed.

1.5.4 The right to request a restriction on the processing of personal data (Art. 18 GDPR)

You have the right to request a restriction on the processing of your personal data if:
– you question the accuracy of your personal data – in this case we will limit the processing of your personal data for the time necessary to verify the accuracy of your data;
– if the processing of your data is against the law, and instead of deleting personal data you will request restricting the processing of your personal data;
– your personal data is no longer necessary for the purposes of processing, but it is still required to determine, pursue or defend your claims;
– when you have lodged an objection to the processing of your personal data – until it is determined whether our legitimate interests override the grounds indicated in your objection.

1.5.5 Right to object to the processing of personal data (Art. 21 GDPR)

You have the right to object at any time to the processing of your personal data in association with:
– processing necessary for performance of a task carried out in the public interest or processing necessary for the purposes of the legitimate interests pursued by PTC Czajkowski or by a third party;
– processing for the purpose of direct marketing.

1.5.6 The right to transfer your personal data (Art. 20 GDPR)

You have the right to receive from PTC Czajkowski your personal data in a structured, popular, machine-readable format, as well as the right to send it to another controller of personal data.

As a standard, PTC Czajkowski provides personal information in the XLS format, but if you prefer that the data was provided to you in a different format, please indicate your preferred format in your request.

If possible, PTC Czajkowski will try to provide you with data in the indicated format.

You can also request that PTC Czajkowski send your personal data directly to another controller (if it is technically possible).

1.6 The right to withdraw consent

You may withdraw the consent to the processing of your personal data at any time.

The withdrawal of consent to the processing of personal data does not affect the legality of the processing done by PTC Czajkowski based on your consent before its withdrawal.

In case you intend to withdraw your consent to the processing of personal data for the purpose of providing the “Newsletter” service, you can opt out of it by clicking the individual link in the Newsletter “Unsubscribe from the newsletter”

1.7 Complaint to a supervisory authority

If you believe that the processing of your personal data violates personal data protection regulations, you have the right to submit a complaint to a supervisory authority, in particular in the member state of your habitual residence, your place of work or the place where the alleged infringement was committed.
